Patent Title

The objective of Patent Title is to identify the complete abstract or chain of title, including surface, severed mineral rights, and O&G interests for a given property. Patent Title is often used for condemnation or renewable projects.

Patent Title package includes:

  • Limited Title Certificate (LTC) will include an “Exhibit A” where the legal description is typed exactly as found on the vesting deed(s), including any scrivener errors (spelling, punctuation, etc.), less any outsales, followed by a Vesting Deed summary
  • Chain of Title (COT) Split interest, mineral, and O&G chains will be color- coded
  • Property Card
  • GIS Map(s)
  • Project Map
  • Deed Plots, if plottable
  • Flow chart (if the chain of title splits)
  • Vesting Deed(s)
  • All documents found of record
  • Patent and Original Survey (if available)
  • Supporting documentation

The research will include the following:

  • Research will begin with the Patent found on the BLM website or the earliest document recorded in the county land records
  • Research will include all surface, severed interest (minerals, wind/solar, timber, etc.), and O&G chains found of record within the certified search period – all interests foundof record will be ran forward
  • Research will include a search of all county records, and courts, as needed
  • Internet research will be completed as needed (research may be necessary for heirship/curative title purposes)
  • Research requirements are clearly identified and available for review by the client
